BP is asking a US court to help retrieve hundreds of millions of dollars the oil giant claims to have overpaid for damages caused as a result of the Gulf of Mexico oil spill four years ago.
A month ago BP was successful in obtaining a court order which revised the way losses due to the spill are calculated.
This isn’t the only issue BP is fighting before the courts. District and appeals courts in the US have upheld a ruling stating under the settlement BP agreed to, proof of direct harm isn’t needed to claim compensation from BP. The next stop is the Supreme Court.
All the legal battles are not endearing the company to people in the Gulf region affected by the 2010 spill. An emailed statement from attorneys Steve Herman and Jim Roy states, “this is just another attempt by BP to back out of the commitment it made to the Gulf … Every claim that was paid was done so according to an independent trust agreement that BP co-authored and agreed to.”
